Welcome to Talli! The terms "we," "us" and "our" refer to Talli. Talli manages this store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a personalized shopping experience (the 'Services').

To make use of the Services, including visiting or browsing our webshops or purchasing products or services offered by us, we may ask you to provide certain information, such as your email address and your invoice, payment and shipping details. You declare and guarantee that all information you provide in our stores is accurate, up-to-date and complete, and that you have all the rights necessary to provide this information.
You are solely responsible for maintaining the security of your account's login details and for all activities in your account. You may not transfer, sell, assign or license your account to anyone else.

We strive to provide the most accurate description of our products and services in our webshops. But keep in mind that the colours and appearance of the product may differ from how they are displayed on your screen. This relates to the type of device you use to access the store and the settings and configuration of the device.
We do not guarantee that the appearance or quality of your purchased products or services meets your expectations or corresponds to the view or description in our webshop.
All product descriptions may be changed at any time and without prior notice. We reserve the right to stop selling a product at any time and may limit the number of products we offer per person, geographical region or jurisdiction on a case-by-case basis.

ARTICLE 3 - OBJECTIVES
When you place an order, you make an offer to purchase. Talli reserves the right to accept or refuse your order at its sole discretion for any reason. Your order was only accepted after Talli confirmed it. We must have received and processed your payment before your order is accepted. Check your order carefully before sending it. Talli may not honour a request for cancellation after your order has been accepted. In case we do not accept, modify or cancel an order, we try to notify you by contacting you via the email address, billing address and/or telephone number you provided during the ordering process.
You can only return or exchange purchases in accordance with us return policy. 
You declare and guarantee that your purchases are intended for personal use or use within your household and not for commercial resale or export.

ARTICLE 4 - PRICES AND INVOLVEMENT
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service is the price applicable at the time you place the order. This price is stated in the confirmation email you receive after your order. Unless expressly stated otherwise, the prices shown are exclusive of taxes, shipping costs, handling costs, customs duties and import duties.
The prices displayed in our webshops may differ from the prices in physical stores, or in webshops or other stores managed by third parties. We may from time to time offer promotions for the Services that may affect pricing and to which general terms and conditions apply that are independent of these Terms and Conditions. In the event of discrepancy between the terms of a promotion and these Terms, the promotional conditions shall prevail.
You agree to provide current, complete and correct purchase, payment and account details for all purchases you make in our stores. You agree to update your account and other information, including your email address, credit card numbers and credit card expiry dates, immediately upon change, so that we can perform your transactions and contact you if necessary.
You declare and guarantee that (i) the credit card details you provide are correct, correct and complete; (ii) you are authorized to use the credit card for purchases; (iii) your expenses are approved by the credit card company; and (iv) you pay the costs you incur according to the prices shown, including shipping costs, handling costs and all applicable taxes, if applicable.

ARTICLE 5 - SHIPPING AND CARE
We are not liable for delays in shipping and delivery. All specified delivery times are only estimates and are not guaranteed. We are not liable for delays caused by carriers, customs clearance or events that we have no influence on. After we have delivered the products to the carrier, the ownership and risk of loss have been transferred to you.

ARTICLE 6 - INTELLECTUAL PROPERTY
Our Services, including, but not limited to, all trademarks, brands, texts, displays, images, graphical elements, product reviews, video and audio, and their design, selection and preparation, are property of Talli, its affiliates or licensees, and are protected by patent law, copyright and intellectual property law laws in the United States and other countries.
These Terms allow you to use the Services exclusively for personal, non-commercial purposes. It is not permitted to reproduce, distribute, modify, create derivative works from, publicly display, perform, republish, download, store or send any material within the Services without our prior written consent. Except as expressly provided in these Terms, nothing in these Terms grants you a license or other rights based on a patent, a trademark, a copyright or any other intellectual property of Talli, Shopify or any third party. Unauthorized use of the Services may constitute a violation of federal and national intellectual property laws. All rights not expressly granted in these Terms are reserved for Talli.
Talli's names, logos, product names, service names, design elements and slogans are trademarks of Talli or its affiliates or licensees. You may not use such trademarks without Talli's prior written consent. Shopify's name, logo, product names, service names, design elements and slogans are Shopify's trademarks. All other names, logos, product names, service names, design elements and slogans within the Services are trademarks of their respective owners.

ARTICLE 7 - OPTIONAL TOOLS
You may be able to access tools for customers offered by third parties under the Services. We do not monitor these tools and have no control or influence on them.
You acknowledge and agree that we offer access to such tools in their current state and on the basis of availability, without any guarantees, statements or conditions of any kind and without any recommendation. We are not liable in any way for damage arising from or related to your use of optional third party tools.
You use optional tools offered through the site at your own risk and at your discretion. You must make sure that you are aware of and agree to the conditions under which the tools are provided by the relevant external party.
In the future we may also offer new features through the Services (including the release of new tools and resources). Such new functions are also considered as part of the Services and are subject to these Terms of Service.

ARTICLE 9 - RELATION WITH SHOPIFY
Talli uses Shopify so we can provide you with the Services. However, all sales and purchases you make in our shop are handled directly with Talli. By using the Services, you acknowledge and agree that Shopify is not responsible for any sales related aspect between you and Talli, including injury, damage or loss due to purchased products and services. In doing so, you expressly exempt Shopify and its affiliates from all claims, damages and liabilities that may arise from or relate to your purchases and transactions with Talli.

ARTICLE 10 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy, which you can view here [LINK]. Certain personal information may also be subject to Shopify's Privacy Policy, that you here . By using the Services, you confirm that you have read the relevant Privacy Policy.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services to deliver and improve the Services. Information you submit to the Services will be forwarded to and shared with Shopify, as well as with third parties who may be in countries other than where you live, so that they can provide your services. In addition, you agree not to: (a) upload or send viruses or other types of harmful code that in any way affect or may affect the functionality or functioning of the Services; (b) to reproduce, duplicate, copy, sell, sell or exploit any part of the Services; (c) to collect or track personal information from others; (d) to use spam, phishing, pharm, pretext, spider, crawl or scrape; and (e) disrupt or circumvent the security functions of the Services, related websites, other websites or the Internet. The following Articles shall continue to apply after termination: Intellectual property, Feedback, Termination, Rejection of warranties, Limitation of liability, Safeguards, Separability, Declaration of distance; Full Agreement, Transfer, Applicable Law, Privacy Policy and any other provisions that by their nature must remain valid even after termination.

The information provided about or via the Services shall be made available only for general information purposes. We do not guarantee the accuracy, completeness or usability of this information. Every confidence you put in this information is entirely at your own risk. SERVICES AND ALL PRODUCTS PROVIDE BY TALLI ARE TO BE DISCOVERED BY TALLI, WITHOUT ANY DECLARATION, WARRANTIES OR CONDITIONS, EXPLICIAT OR IMPLICIAT, WITH ALL IMPLICATE GUARANTEES OR CONDITIONS ON SALEABILITY, SALEABLE QUALITY, SUITABILITY FOR A SPECIFIC PURPOSE, SUSTAINABILITY, PROPERTY AND NON-INJECTION. WE GEAR, DEAL OR PROVIDE YOUR USE OF THE SERVICES IS UNFRIENDED, TEMPORARY, SAFE OR FREE OF ERRORS. IN SOMMY LEGAL AREAS, IS THE REDUCTION OF IMPLICIATE OR OTHER GUARANTEES LIMITED OR NOT ADDED. THE PROFESSIVE ADOPTION IS NOT APPLICABLE TO YOU.

ARTICLE 16 - LIABILITY LIMITATION
FOR ALLOCATION BY LAW, TALLI, OUR PARTNERS, DIRECTORS, OFFICERS, CO-OPERATIONRS, AFFILIATES, REPRESENTATIVES, CONTRACTANTS, SERVICE PROVIDERS AND LICENTORS, OR THAT OF SHOPIFY AND THEIR AFFILIATES, ARE NOT INTENDABLE TO LEAST, VERLIES, CLAIMS OR DIRECT, INDICATE, INDICATE, INCIDENTAL, RIGHTFUL, SPECIAL OR EFFICIENT OF WHAT OR EARTH. This is by including, but not limited to, profit-sharing, reverse charge, misappropriated deposits, data loss, replacement costs or any associated injury, such as the use of any of the services or products which have been provided by the service provider, or any other CLAIM relating to the use of the service or a product. This is, however, not limited to, ERRORS or LOCATIONS IN THE CONTENT, OR DETECTED OR DISCONTINUED OF ANY NATURE THAN THAT WHICH HAS BEEN MADE UP AS A consequence OF THE USE OF THE SERVICES OR CONTENT THAT (OR AN PRODUCT) HAS BEEN LOCATED, SENT OR IS AVAILABLE ON OTHER WAY VIA THE SERVICES, IF YOU ARE PROPOSED TO THE HIGHNESS OF INJURY.

ARTICLE 17 - SECURITY
You agree to indemnify, defend and compensate Talli, Shopify and our affiliates, partners, officers, directors, employees, representatives, contractors, license providers and service providers for all costs relating to losses, damages, liabilities or claims, including reasonable legal assistance, that are to be paid to an external party as a result of or resulting from (1) breach by you of these Terms of Service or documents included in them by reference; (2) violation by you of any law or the rights of any third party; or (3) your access to and use of the Services.
We will inform you in the case of a claim giving you the right to safeguard, provided that failure to notify you in time does not relieve you of your obligations, unless it substantially prejudices you. We may arrange the defense and settlement of such a claim at your expense, including the use of a lawyer, but we settle claims requiring non-monetary obligations from you not without your consent (which you may not withhold on unreasonable grounds). You are obliged to cooperate in the defence of claims that entitle you to safeguard, including by providing relevant documents.

ARTICLE 18 - SABILITY
If any provision in these Terms of Service is declared unlawful, void or non-enforceable, the provision nevertheless remains enforceable to the extent permitted by applicable law. The non-enforceable part is deemed to be separate from these Terms of Service. Such determination shall not affect the validity and enforceability of the other provisions.

ARTICLE 19 - STATEMENT OF DISTANCE; FULL AGREEMENT
Failure by us to exercise or enforce any right or provision related to these Terms of Service shall not constitute a waiver of this right or provision.
These Terms of Service and all policies or business rules placed by us on this site or in relation to the Service constitute the full agreement and agreements between you and us, and regulate your use of the Service. These Terms replace any previous or simultaneous agreements, communications and proposals, verbally or in writing, between you and us (including, but not limited to, previous versions of the Terms of Service).
Any ambiguity in the interpretation of these Terms of Service cannot be explained to the disadvantage of the author.

You may not delegate, transfer or assign this Agreement or your rights or obligations under these Terms without our prior written consent. We declare null and void an attempt to do so. We may transfer, assign or delegate these Terms and our rights and obligations to others without your consent or notification.

These Terms of Service and any individual agreements under which we provide you with our Services are subject to and interpreted in accordance with the federal and state-specific or provincial courts in the jurisdiction where Talli has its head office. You and Talli agree to the jurisdiction and personal jurisdiction of the court in question.
